Terms of Use

1. Acceptance and Parties

Besin App (the “App”) is developed and provided by Nomadsoft Limited, a company incorporated under the laws of the United Kingdom (the “Company,” “we,” “us,” or “our”). By downloading or installing the App, visiting besin.app, or using any feature, you confirm that you have read, understood, and accepted these Terms of Use (the “Terms”) and our Privacy Policy in full.

If you do not accept these Terms, do not use the App and remove it from your device.

2. Description of the Service

Besin App helps users scan food-product barcodes, review nutrition facts and ingredients, and view algorithmic scores.

• View product information and algorithmic scores through barcode scanning.
• Review nutrition facts and ingredient analysis.
• Search for and compare products.
• Match a product by analyzing its photo with artificial intelligence through the Google Gemini API.
• Submit photos of missing products for possible addition to the database.
• Create a personal search and scan history.
• Rate products, pick tags, and write reviews.
• Receive push notifications about in-app updates and information.

3. User Accounts

You may need to create an account to use some features. When creating and using your account, you must comply with the following requirements:

• Provide accurate and up-to-date information.
• You are fully responsible for account security and for keeping one-time login codes sent to your email confidential.
• You are legally responsible for all activity that occurs through your account.
• You may not transfer or share your account with another person.

4. Age Requirement and Parental Responsibility

The App is intended for a general audience and is available to users of all ages. However, children under 13 may use it only with the explicit approval of a parent or legal guardian. If we determine that a user under 13 created an account without parental consent, we reserve the right to close the account immediately.

A parent or guardian who learns that a child under 13 is using the App without permission should contact us at iletisim@besin.app.

5. Acceptable Use

By using the App, you agree to follow these rules:

• Do not use the App for purposes that violate applicable law.
• Do not endanger the App's security, overload the system, or attempt unauthorized access.
• When using photo product search or submitting products, do not upload misleading, irrelevant, obscene, copyright-infringing images or images containing faces, identity documents, addresses, contact details, or another person's personal data.
• Do not copy, reverse engineer, or scrape the App's algorithm, database, or source code without authorization.
• Do not share content intended to mislead the system, other users, or third parties.
• In product reviews, do not post political content, insults, profanity, hate speech, ads, links, or personal data (names, phone numbers, addresses, email addresses, social media accounts, etc.), and do not make unverifiable serious claims about brands or manufacturers.

6. User Content and License

You retain your rights in photographs and other content submitted with a product suggestion (“User Content”). By submitting User Content, you grant Nomadsoft Limited a worldwide, non-exclusive, royalty-free licence to review it, use artificial intelligence to identify the product and packaging information, make necessary adjustments, add it to the product catalog, and display it in the Besin application and on besin.app.

Images used with photo product search and product suggestions may be analyzed automatically through the Google Gemini API. AI-generated results are not guaranteed to be accurate or complete. You confirm that you have the right to submit the User Content and grant this licence, that it contains no personal data, and that it does not infringe any third party's copyright, trademark, privacy, or personality rights. You may request removal of a specific image by contacting iletisim@besin.app. Processing details are described in the Privacy Policy and KVKK Notice.

6.1 Product Ratings and Reviews

You can rate products, pick tags, and write reviews. Reviews should only describe your own experience with the product. Written reviews are published with your initials (for example "F... T...") after an AI-assisted automated check. Ratings and tags left without text are shown without your name.

By submitting a review, you grant Nomadsoft Limited a worldwide, non-exclusive, royalty-free licence to show it in the Besin application and on besin.app, to check it against the content rules, and to improve the service. Reviews are the opinions of users, not of Nomadsoft Limited.

There is no tolerance for content that breaks the rules. Nomadsoft Limited may, without notice, refuse to publish, hide, or remove reviews that it finds to break the rules or that other users report, and may stop users who break the rules from writing reviews. You can report a review you find inappropriate with the Report option in the App.

You can delete your rating and review at any time on the product page in the App. If you delete your account, your ratings are deleted and your written reviews and tags remain anonymously, without a link to your account. You may ask us to remove them at iletisim@besin.app.

7. Intellectual Property

The App and its content—including the scoring algorithm, design, code, graphics, logos, and text—belong to Nomadsoft Limited and are protected by national and international copyright, trademark, and intellectual-property laws.

You may use the App only for personal, non-commercial purposes. Copying, distributing, adapting, or commercially exploiting any part of it without permission is prohibited.

8. Disclaimers and Limitation of Liability

The App and all of its features and content are provided “AS IS” and “AS AVAILABLE.” You assume all risks arising from your use of the App.

8.1 Not Medical or Dietary Advice

Product information, nutrition facts, algorithmic scores, AI-generated product summaries, and assessments in the App are for general information only. They are not medical advice, a diet plan, a nutrition prescription, or professional healthcare guidance, and they make no health claim. Consult a qualified doctor or dietitian before making decisions related to your health, diet, or eating habits. The user alone is responsible for outcomes of decisions based on App information.

8.2 Allergens and Health Risks

To the fullest extent permitted by law, Nomadsoft Limited accepts no civil, criminal, or financial liability for allergic reactions, food poisoning, illness, bodily harm, or death resulting from reliance on App information instead of the physical package label.

8.3 Algorithm and Scoring Accuracy

The scoring system is based on an independent, original algorithm developed by Nomadsoft Limited. Scores are not absolute scientific facts, government approvals, or certifications. Users are solely responsible for interpreting them and for purchase or consumption decisions based on that interpretation.

8.4 Manufacturer and Third-Party Requests

Scores reflect Nomadsoft Limited's independent algorithmic assessment and are not intended as commercial disparagement or unfair competition against any product, brand, or manufacturer. A manufacturer or distributor may contact iletisim@besin.app to dispute a score. We reserve the right to correct, update, or remove content independently of the algorithmic assessment.

8.5 Errors, Interruptions, and Data Accuracy

We do not guarantee that product information, nutrition facts, or ingredient lists are 100% accurate. Nomadsoft Limited is not liable for technical errors, server interruptions, database issues, or errors in third-party sources. Report inaccuracies or omissions to iletisim@besin.app.

8.6 Maximum Liability

To the fullest extent permitted by law, Nomadsoft Limited's total liability to a user for all claims, losses, or obligations is limited to the total amount that user paid for the App. Because Besin App is free, that amount is deemed to be zero (0). Nomadsoft Limited is not liable for indirect, incidental, special, consequential, or punitive losses, including loss of profit, data, reputation, or healthcare expenses.

8.7 UK Consumer Rights Act

For consumers residing in the United Kingdom, the disclaimers above do not affect rights that cannot lawfully be excluded under the Consumer Rights Act 2015 or other applicable UK consumer-protection legislation.

9. Force Majeure

Nomadsoft Limited is not liable for interruption, delay, or termination of the service caused by events beyond its reasonable control, including natural disasters, epidemics, cyberattacks, infrastructure failures, power cuts, internet-provider issues, government action, war, or terrorism.

10. Account Termination

If you breach these Terms—particularly through improper uploads, system manipulation, or unlawful use—we may suspend or permanently delete your account without prior notice.

You can delete your account at any time from Profile/Settings in the App, or submit a request to iletisim@besin.app.

11. Changes

We may update these Terms from time to time. Material changes will be announced by in-app notification or email. Minor changes, such as typo fixes or link updates, may take effect without prior notice. Continued use after an update constitutes acceptance of the revised Terms.

12. Governing Law and Jurisdiction

These Terms are governed by the laws of England and Wales, and the courts of London have jurisdiction over disputes arising from them.

Users residing in Türkiye continue to benefit from mandatory consumer-protection rights under Turkish law and may apply to the consumer courts and consumer arbitration committees in their place of residence.

13. Severability

If a competent court finds any provision invalid or unenforceable, that provision will be severed and the remaining provisions will continue in full force.
